GENERAL TERMS AND CONDITIONS OF THE VEHICLE RENTAL AGREEMENT
These GENERAL VEHICLE RENTAL CONDITIONS (hereinafter referred to as the "General Conditions") govern the contractual relationship between AIRSTEMANO S.L., the operating company of the commercial entity U-MOKE (hereinafter referred to as the "Lessor"), with its registered office at Calle de Calvia, 18 07015 Palma de Mallorca, Balearic Islands, with CIF B21786041, and the paying client (hereinafter referred to as the "Renter"), by virtue of which the Lessor grants the Renter the use of a vehicle (hereinafter referred to as the "Vehicle") in accordance with the terms, rates, and other conditions stipulated by the parties in the rental agreement (hereinafter referred to as the "Agreement"), which will be drawn up and signed on the Lessor's premises. In the event of a discrepancy between the content of these General Conditions and that of the Special Conditions signed between the parties, the latter shall prevail.
1. Purpose of the Agreement
This is the rental without a driver of the vehicle described in the Special Conditions of the Agreement for the private transport of passengers and their luggage, in compliance with all the General Conditions established in this document and described below. The Renter is required to keep a copy of this Agreement in a visible place inside the vehicle at all times.
2. Rental Period, Pick-up (Check-out), Return (Check-in), and Extension
The formalization of the rental is conditional on U-MOKE's verification that the Renter meets the mandatory requirements stipulated in the Agreement. The minimum rental period will be 1 day (24 hours) and the maximum period will be determined according to the Agreement. Rental days will be calculated on a 24-hour basis, with a grace period of 59 minutes from the vehicle's Check-In date and time indicated in the Agreement. In the event this aforementioned period is not respected, the Lessor will be authorized to collect the rental amount from the conclusion of the contract until the return of the vehicle, in accordance with the Valid General Tariff, taking into account mileage, damages, and a penalty for economic damages caused. This amount will be added daily from the Check-In date until the return or recovery and preparation of the vehicle. If the Renter abandons the vehicle, in addition to the aforementioned fees, a charge for the recovery of the vehicle as well as all fees and costs related to its recovery will be billed. Performing the Check-In before the end of the period will not result in the return or refund of the price indicated in the Agreement, as it is considered a unilateral termination of the contract by the Renter. If the Renter breaches any of the points established in the General or Special Conditions of the Agreement, the Lessor reserves the right to take back the vehicle from the Renter at any time and claim damages. For operational reasons, the Lessor reserves the right to replace the vehicle at any time with another of similar characteristics after informing the Renter in advance. The Check-Out and Check-In will take place at the U-MOKE facilities where the Agreement was signed, within the deadlines and terms stipulated in the Special Conditions of the Agreement. U-MOKE offers the Renter the option to check-in at company facilities other than where the Agreement was signed (One Way fee), subject to the conditions and restrictions of this service, indicated on our website and those provided for in point 16, within the same deadlines and according to the terms stipulated in the special conditions of the Agreement; the renter must pay the One Way fee. If the check-in is not performed or if the vehicle is abandoned, the renter will be charged the recovery fee for the vehicle, as well as all fees and costs incurred as a result of the recovery and the rental days due, in accordance with the general current rate indicated on the website or at the lessor's facilities, for the periods between the check-in time set in the contract and the actual time of recovery and preparation of the vehicle.
2.1. Agreement Extension
The renter must give prior notice, by telephone and/or in person to U-MOKE, at any time before the end of the rental period set in the contract. The minimum extension period for a contract is at least 1 day (24 hours), which can be extended according to the special conditions of the contract and the rented vehicle, subject to availability. In the event that the Renter wishes to keep the Vehicle for a longer period than initially agreed, the Renter undertakes to obtain the express and prior authorization of the Lessor and to immediately pay the amount of the additional deposit for this extension, the price applicable to the rental extension period being that indicated in accordance with the General Price List in force, established on the U-MOKE website or facilities or other means considered by U-MOKE. Under no circumstances may the price in effect at the beginning of the lease be used for a lease extension. The Lessor reserves the right to refuse extension requests for operational reasons. The use of the vehicle after the end of the rental period or its extension will be considered unauthorized use for the purposes of point 12 of this contract, and a complaint will be filed for misappropriation.
2.2. Late Pick-up
During the opening hours for the "check-out" of the reservation, U-MOKE will grant a grace period of 4 hours to pick up the vehicle at no additional cost. Once this grace period has passed, the renter will have the option to reactivate their reservation within a maximum period of 48 hours from the "check-out" time of the reservation, subject to availability and the store's opening hours. The reactivation of the reservation will result in an additional charge for the customer, unless otherwise indicated in the special conditions. The cost of this service is detailed in the attached appendix.
2.3. Pick-up and Return Outside Opening Hours
The Check-In and Check-Out of the vehicle can be done during the specified opening and closing hours of the store selected in your reservation; however, in case of Check-In or Check-Out outside the established store hours, an additional fee will be applied according to the costs of this service detailed in the attached appendix.
3. Driver(s)
The renter and any additional drivers must be at least 18 years old. They must present their identity card or passport and their driving license, both documents must be valid for the duration of the rental, be in physical format, legible and in good condition, but not photographs or photocopies. Valid driving licenses from EU and EEA citizens (Iceland, Liechtenstein and Norway) are accepted by law and valid for driving in Spain. Licenses issued in third countries will be accepted if they meet the requirements of Article 21 of the General Regulations for Drivers; provided that the license is in force, the holder is of the required age in Spain to obtain an equivalent Spanish license and that no more than six months have elapsed since the holder acquired normal residence in Spain. In all other cases, an international permit must be presented along with the valid driving license issued by the country of origin. For more information, we recommend consulting the website of the General Directorate of Traffic (DGT): "DGT - Permisos válidos para conducir en España (Valid driving licenses for driving in Spain) or contacting the consulate in Spain of the country that issued your license directly. It is the customer's responsibility to check if their driving license is valid for driving in Spain. Only driving licenses in electronic or digital format in the official DGT application will be accepted. The conditions relating to the extras for young drivers (from 18 to 25 years old, both included) and additional drivers (second driver) are established in point 18. Only the person or persons identified and accepted by U-MOKE in the rental agreement and/or any annex thereto are authorized to drive the vehicle. Any failure to comply with this condition will result in legal action by U-MOKE, and claims may be made against the holder of the rental agreement.
4. Vehicle Maintenance
The Renter receives the Vehicle in perfect condition and must keep it in good condition, with any external or internal modifications being prohibited. If modifications are made, the cost of repairs to restore the Vehicle to its original state, as well as the costs of any damages and losses, will be borne by the Renter. Repairs in a garage or the replacement of parts may only be carried out after obtaining the express and written authorization of the Owner. No repair costs will be reimbursed, except in cases where the Owner pre-approves the estimate and the garage where the repair would be carried out. In the absence of express and written consent, the payment of garage costs and spare parts in question will be the sole responsibility of the Renter.
4.1. Vehicle Accessories
The Renter will receive the vehicle with the necessary documentation, tools, safety vest, triangles, chargers, a Pioneer radio, a phone holder, etc., as well as the vehicle key. The Renter must check these accessories at the time of picking up the vehicle at the start of the rental and in case of any incident, must report it to a U-MOKE representative before leaving. The Renter agrees to return these accessories in the same condition as they were delivered. In the event of failure to return the accessories at the end of the rental agreement, the Renter must pay the value of the non-returned accessories in accordance with the provisions of the damage document attached to this contract.
4.2. Vehicle Cleaning and Condition
The Renter agrees to return the vehicle in a reasonably clean condition, both inside and out. If the vehicle is returned in a condition that requires extraordinary cleaning, an additional cleaning fee will be charged. The cost of this service is detailed in the attached appendix.
5. Vehicle Identification
The Renter must keep the U-MOKE identification stickers and license plates on the rental Vehicle. The removal of these elements will result in a surcharge for restitution, plus the payment of the corresponding mandatory administrative penalty. In accordance with certain municipal ordinances, the document issued proving that the Vehicle is a rental vehicle must be placed in a visible place at all times. In case of non-compliance with this obligation, the Renter will be held responsible for the related penalty and will have to pay the management fees set out in point 13.
6. Lost and Found
The Renter must remove all personal belongings from the Vehicle. The Lessor is not responsible for any items found in the Vehicle. Nevertheless, any object found in the Vehicle may be sent to the Renter upon express and written request via contact@u-moke.com. In this case, the Lessor will charge a management fee for sending the items, in addition to the shipping costs, which will be borne entirely by the Renter.
7. In case of breakdown or accident outside the agreed rental period
As soon as the contractual relationship between the Renter and the Lessor (hereinafter referred to as the "Parties") ends, the Renter is 100% responsible for the payment of repairs and expenses incurred on the Vehicle.
8. Prices and Rates
The prices of the Agreement will be in accordance with the Valid General Tariff publicly displayed in U-MOKE's facilities and websites, or by other means determined by the Lessor, the content of which the Renter expressly declares to be aware of prior to this Agreement. All prices will be indicated and valued in euros (€). The price of fuel will be detailed at the time of signing the Agreement between the parties. Due to the fluctuation of fuel prices, it is impossible to inform the Renter of its price in these General Conditions.
8.1. Digital Key Rate
8.1.2. Activation of the Digital Key service
To be able to use the Digital Key service, it is necessary to activate it at least 24 hours before the vehicle pick-up time, and to follow the indicated steps for document validation, proof of life, and digital contract signature. It is necessary to validate both the identity card or passport and the driving license. All documents to be validated must have sufficient quality/resolution. The sufficient quality level is determined by the document validation and biometric identity software when they are able to read the information contained in the documents. The biometric validation software is chosen by U-MOKE and can be changed at any time without prior notice.
In the event that the documents are not provided or are not of sufficient quality, or if the validation and contract signing process is not completed, you will not be able to unlock the vehicle digitally and will have to collect the keys at the counter.
The truthfulness and validity of the documents provided are the sole responsibility of the customer.

Important: Check that the data provided (email and telephone) are correct, as they will be the means of communication to provide the links for opening/closing the vehicle. In case of an error in the registration of the data and therefore not receiving the relevant links, you must inform customer service or staff as soon as possible to correct the error in the erroneous data.
8.1.3. Vehicle Pick-up and Return
Pick-up (Check-out): You will receive a link to open the vehicle between 24h and 2h before the start of the reservation by SMS and email, indicating the registration and location of the vehicle (floor and parking space). The first opening of the vehicle will be done via the available link. In the unlocking link, you can see the exact location of the vehicle. It is necessary to be in front of the vehicle to be able to open it. The link received is personal and non-transferable, and it is expressly forbidden to share it with third parties not identified as drivers of the contract.
In case of a problem with the opening link, you can contact the telephone number indicated in the SMS/email, or the U-MOKE staff directly.
The keys and, if applicable, any parking exit ticket or card you may need are in the vehicle's glove box. If they are not in the glove box, you must contact the store immediately.
Once you have unlocked the assigned vehicle via the link, you will receive your contract indicating the vehicle registration as well as any existing damage by email. If the vehicle has damage not included in the list of existing damage contained in your contract, you must immediately inform the store staff before moving the vehicle.
Return (Check-in): The return will take place at the same location where the vehicle was picked up, except in cases where the One Way extra has been booked. The vehicle must be returned to the drop-off area of the designated car park in the instructions by U-MOKE (the same one where the vehicle was picked up).
The vehicle will be locked exclusively via the return link that the customer will receive 12 hours before the scheduled return date. The link will be available until 2 hours after the scheduled return time. In case of non-compliance with this period, the Lessor will be entitled to charge the rental amount from the end of the contract until the return of the vehicle, according to the general current rate, mileage, damages and a penalty for economic damages caused, this amount being added each day, from the date on which the Check-in should have been made until the return or recovery and preparation of the vehicle by U-MOKE.
Under no circumstances should the key be used to lock the vehicle during the return process. In case of using the key instead of the locking link, the contract will remain in force and the same conditions will apply as if the Check-in had not been carried out.
The vehicle key must be deposited in the store's key box, or handed over to the U-MOKE drop-off staff.
In case of a problem with the locking link, you can contact the telephone number indicated in the SMS/email, or the drop-off staff directly.
8.1.5.3. Insurance
All Groups have mandatory third-party liability insurance (CDW), and are offered with the U-MOKE + coverage involving a reduction of the deductible and the deposit.
8.1.6 U-MOKE +
Refundable rate that allows for modifications, which are subject to availability and the current rate on the day of the modification. Additional charges may apply depending on the date, availability, change of Store or vehicle category, in accordance with the rate in force at that time. In addition, this rate allows for the cancellation of the reservation at no additional cost up to 2 hours before the vehicle pick-up.
8.1.6.1 Document Validation
The renter and any additional drivers must meet the requirements for the documents to be presented for the formalization of the contract, which must be valid, current, and in physical and legible form, as well as the minimum age requirement, all specified in point 3 of these conditions. The truthfulness and validity of the documents provided are the sole responsibility of the customer. If you come in person to one of our offices, your documents will be validated at the counter, at the time of formalizing the contract. In the case of applying a digital key and/or the vehicle delivery/pick-up service by U-MOKE Plus at the destination indicated by the customer, the validation of the documents to be provided will be carried out during online check-in, at least twenty-four (24) hours before the delivery/pick-up time.
To validate the documents, it will be necessary to follow the indicated steps regarding document validation, proof of life, in order to sign the digital pre-contract. It is necessary to validate the identity card or passport as well as the driving license. All documents to be validated must be of sufficient quality/resolution. The sufficient quality level is established by the document validation and biometric identity software when they are able to read the information contained in the documents. The biometric validation software is chosen by U-MOKE and may be changed at any time without prior notice.
If the reservation includes an additional driver, all the above provisions also apply to them. In case of non-validation of the documents by the additional driver, they will not be validated and will not be able to drive.
8.1.6.2 Coverage
All groups have mandatory third-party liability insurance (CDW) which includes roadside assistance. Group 2 includes a reduced deductible and roadside assistance. Regardless of the coverages subscribed, a hold will be placed as a deposit, as specified in point 9.2 of these conditions.
8.1.6.3 Vehicle Delivery and Collection Service: Delivery
To be able to use the U-MOKE Delivery service, it is mandatory to complete the online check-in at least (24) twenty-four hours before the vehicle delivery time. If the documents are not provided or cannot be validated, for reasons not attributable to U-MOKE, the vehicle delivery service reservation will not be validated, and the customer will have to go to the store to pick up the vehicle.
Once the online check-in is completed, the customer will receive, (24) twenty-four hours before the vehicle delivery time, an access link, valid for a maximum of (4) four hours, in order to block the deductible/deposit on the customer's credit card, in accordance with the general rental conditions. Once the (4) four-hour period has elapsed, if the customer has not made this block, the delivery service will be automatically canceled and will not be refundable.
The provision of this service will be subject to the existing availability at the time of the request, for the destination and/or route selected by the customer in the authorized territory, and will require prior written confirmation from U-MOKE.
Vehicle Delivery. The vehicle delivery time is that requested by the customer during the reservation. The main driver or additional drivers, provided that the latter have completed the online check-in, must be present at the address indicated in the reservation at the time indicated therein. U-MOKE will grant a waiting period of fifteen (15) minutes free of charge after the delivery time reserved by the customer. Once this period has elapsed, the vehicle will be returned to the agency indicated in the reservation, where the customer can pick it up within a maximum of six hours from the delivery time indicated in the reservation. If the customer contacts U-MOKE to report a delay in arrival, after the grace period, and insofar as it is operationally possible, the waiting time may be extended at an additional cost of (20) twenty euros per (30) thirty-minute waiting period. If the customer does not show up at the delivery location, they will not be entitled to a refund for the delivery service.
The rental will be considered to have started as soon as the customer has received the vehicle keys.
Vehicle Collection. The vehicle collection time is that requested by the customer in the contract. The customer must be present at the indicated time at the collection location established in the contract and hand over the vehicle and keys to U-MOKE. A grace period of fifteen (15) minutes will be granted from the time reserved by the customer for collection. Once this period has elapsed, the delivery service will be canceled and the customer must return the vehicle to the agency indicated in the rental contract. If the customer contacts U-MOKE to report a delay in collection, after the grace period, and insofar as it is operationally possible, the waiting period may be extended at an additional cost of (20) twenty euros per (30) thirty-minute waiting period. If the customer does not show up at the collection location, they will not be entitled to a refund for the delivery service. If the vehicle is not returned at the end of the rental period without U-MOKE having been contacted within four (4) hours for this purpose, a complaint for unlawful appropriation of the vehicle will be immediately filed against the customer. U-MOKE reserves the right to take all necessary legal and logistical actions to recover the vehicle, the costs of which will always be borne by the customer.
Fuel Policy. The refueling policy is "full-full," regardless of the type of fuel used by the vehicle, as specified in point 15 of these conditions. The vehicle's fuel consumption to the delivery/collection address requested by the customer is the responsibility of the customer.
Electric Charging Policy. The vehicle is delivered with a minimum charge level of 85%. For a 1-day rental (24 hours), it must be returned with a minimum charge of 85%. In the case of a "Tour or Circuit" rental, it must be returned the same day with a minimum of 15%.
The modification/cancellation of the reserved delivery service can only be made within a maximum period of (48) forty-eight hours before the delivery/collection time indicated in the reservation.
9. Coverages
The rental company offers you different coverage options at various rates. Groups 1 and 2 have mandatory third-party liability insurance (CDW).
- Group 1 implies a deductible of €2000.00 in case of damage.
- Group 2: U-MOKE + known as "deductible buy-down" reduces the deductible to €400.00 and the DEPOSIT to €1000.00.
If the optional U-MOKE + coverage (deductible buy-down) is not purchased, a block will be placed on the Renter's physical credit card for an amount of €2000.00, as a pre-authorization to cover the deductible and any possible damage to the driven vehicle as stipulated in your rental agreement. If the Renter returns the Vehicle in the same condition as it was picked up, the blocked amount will be refunded.
9.1. Optional Coverages
9.1.1. 24/7 Assistance and Breakdown Service
This additional coverage includes, in case of a domestic vehicle breakdown, a 24-hour telephone service by calling the following number: +34 633 662 681, the replacement or substitution of the Vehicle involved in the incident, roadside assistance by tow truck, going to the scene of the incident as soon as possible. This additional coverage will not apply if the said incident is due to the Renter's negligence or a failure to charge the battery or an accident or the immobilization of the Vehicle due to crimes or offenses committed with it, as specified in points 11.1 and 1. The cost of this service is detailed in the attached appendix.
9.1.2. U-MOKE +
This additional coverage includes a reduction of the deposit to €1000.00 and the deductible to €400.00. The cost of this service is detailed in the attached appendix.
9.2. Deductible / Deposit
Regardless of the coverages subscribed, a block/hold will be made as a Deductible/Security Deposit on the physical card provided, as a guarantee of compliance with its obligations to U-MOKE, as well as to guarantee any possible liability arising during the rental period that must be assumed by the renter. The amount of the deposit will vary depending on the selected options, differentiated between STANDARD / U-MOKE + (Deductible buy-down). This will be done by blocking/holding the corresponding amount on the physical card provided by the main driver or by the additional driver who appears and signs the contract. If this block/hold cannot be made, U-MOKE may refuse the rental. For the Deductible block, a physical credit card must always be provided.
Once the contract is terminated and the necessary checks have been carried out, if no incident related to the rental of the vehicle is found, the blocked/held amount will be released. The release of the block/hold will vary depending on the period set by the issuing bank of the payment card provided. For more information on payment methods, please see point 19.
9.3. General Exclusions of Coverage and Their Corresponding Surcharges
All detailed coverages do not include the following services related to vehicle damage, concerning: structural elements; underbody; interior and exterior equipment, and depending on the coverages subscribed by the renter, roadside assistance fees may apply. This list is provided for informational purposes, due to its extent, we refer to the attached appendix, where all possible damages and/or losses as well as related services, with their respective prices, are specified in detail. Said appendix is available to the public at the facilities, on the U-MOKE websites, or any other means that the Lessor considers appropriate, and the Renter manifests to be expressly aware of its content upon signing this Agreement. All prices will be indicated in Euros (€) and will be those for which any damages, losses and corresponding services will be collected on the invoice issued in the name of the Renter. No form of coverage will cover damage to the insured vehicle as a result of: wars, natural disasters and natural phenomena (hail, snowstorm or others), terrorism, disturbances or riots, actions by the State Security Forces and Bodies, negligence on the part of the Renter, abandonment, accident or immobilization of the vehicle due to crimes or offenses committed with it, and any other activity established in points 11.1 and 12. These damages and corresponding services will be the responsibility of the Renter. In no case will the coverage cover personal effects left, kept or transported in the vehicle.
10. Products and Services
10.1. U-MOKE URBAN
To rent and drive a "U-MOKE URBAN" vehicle, it is imperative to meet the following conditions:
- Have a valid and current driving license, in accordance with the requirements defined in point 3.
- Meet the age criteria.
- Have a smartphone with the "iOS" or "Android" operating system in a compatible version for downloading and using the application, "Google Map and Melib 2025".
- Have previously downloaded the application, be registered and have a valid personal account in accordance with the application's terms of use, have an Internet connection and Bluetooth functionality.
- Have a means of payment accepted by U-MOKE (see point 19).
- Have sufficient legal capacity to enter into a contract with U-MOKE.
10.1.1. Vehicle Reservation Process
To be able to use "U-MOKE Urban", the customer must access their personal account on the "U-MOKE Urban" application previously downloaded on their smartphone, connect to the Internet, activate the Bluetooth functionality and have registered a credit card in their personal account. Once the registration is completed and the account is validated, they can start using the desired service. There is no minimum period between the reservation and the start of the rental. The vehicle reservation can be made up to two months in advance, subject to availability. However, it will not be possible to reserve several vehicles in the same rental time slot with the same user.
10.1.2. Conditions
The customer rents a vehicle of a specific category, unless they are offered the possibility of renting a specific model (always subject to availability). The rented vehicles have mandatory third-party liability insurance (CDW) with U-MOKE URBAN coverage, eliminating the deductible and including roadside assistance (see point 9). The included fuel policy is "full/full" and the same policies indicated in point 15 apply to both fuel and electric vehicles. As part of the rental agreement, a security deposit will be made to guarantee compliance with the obligations contracted by the customer.
10.1.3. Modification or Cancellation of the Reservation
The reservation can be modified, via the application, up to one (1) hour before the rental service, subject to availability. The possible modifications are as follows:
- Before the start of the rental: pick-up location; vehicle model; pick-up and/or return date and time.
- After the start of the rental: return date and time; extension of the rental contract up to a maximum of thirty (30) days, subject to availability and according to the tariff conditions in force at the time of the extension.
In the event of non-extension of the vehicle rental contract and non-return of the vehicle within the period indicated in the reservation, a penalty for non-compliance with the contract will be applied (see point 2).
The reservation can be canceled free of charge up to two (2) hours before the scheduled time of the reservation. If this deadline is not met, the customer will have to pay for the first day of rental (calculated on a 24-hour basis). If the duration of the reservation is less than 4 hours, the amount to be paid will be that of the reserved hours. For fleet management reasons of U-MOKE URBAN, the latter reserves the right to review the number of reservations canceled by the customer, and may proceed to block the user and refuse future reservations if it is found that (3) or more reservations have been canceled within a period of ten (10) days.
10.1.4. Vehicle Pick-up
Vehicles can be picked up at "U-MOKE URBAN" locations up to two (2) hours after the time scheduled in the reservation for the start of the rental. Once the grace period has elapsed, the reservation will be automatically canceled and the total amount of the reservation will be charged. Access to the vehicle will be exclusively via the "U-MOKE URBAN" application, so it is the customer's responsibility to have a smartphone with sufficient battery, an Internet connection, access to their personal account on the application, and Bluetooth functionality. Half an hour before the start of the reservation, the customer will receive information about the assigned vehicle, as well as the rental contract to proceed with its signature. If the contract has not been signed, the assigned vehicle will not be available, the previous reservation will be canceled, and the customer will have to pay for the first day of rental (calculated on a 24-hour basis). U-MOKE URBAN will not be responsible for the non-fulfillment of the rental and any damages that may result if the customer does not comply with all the previously indicated conditions. It will be necessary to stay at a maximum distance of five (5) meters from the vehicle to be able to open and close it.
10.1.5. Vehicle Return
To end the rental, it is necessary to press the "end trip" button via the "U-MOKE URBAN" application. The vehicle must be located within the perimeter of the location indicated during the reservation. The customer will have a period of thirty minutes (30 minutes) to carry out the correct return of the vehicle, starting from the return time scheduled in the rental contract. In case of late return beyond this period, the customer will be charged the rental amount from the scheduled end in the contract, until the effective return of the vehicle, with in addition a penalty for late return in accordance with these Terms and Conditions. If the vehicle is not returned at the end of the rental period without prior contact with U-MOKE URBAN within four (4) hours, a complaint for misappropriation of the vehicle will be filed immediately against the customer. U-MOKE reserves the right to take all necessary legal and logistical actions to recover the vehicle, the costs of which will always be borne by the customer. If the vehicle has not been returned at the end of the rental contract due to a breakdown or accident, any additional coverages subscribed will lose their effect, and the customer will be the sole direct responsible for the payment of damages, repairs and costs, as well as for the repair of any damage to third parties, without exclusion or limitation. The customer will receive the vehicle in perfect working order and must keep it in the same condition. The customer will be responsible for any damage caused to the vehicle during the rental period. The costs of the damages are detailed in the appendix attached to these Terms and Conditions.
10.1.6. Payment Method
Payment must be made via the "U-MOKE URBAN" application. It must be made with the customer's credit card and in advance upon confirmation of the reservation, excluding any possible additional costs that may be generated during the rental period. To confirm the reservation, the customer must register a credit card in their access profile, giving their consent to:
- Save this information with the payment provider in encrypted format.
- Link the credit card to the personal account created in the "U-MOKE URBAN" application.
- The possibility of debiting the amounts due from the bank card.
- Request the bank to block the amount corresponding to the deposit (see point 9.2).
- Authorize the payment of any sum relating to the rental of the vehicle or any other concept inherent to the reservation and the contract.
It is the customer's responsibility to ensure that the credit card information is accurate. The card must be in the name of the holder of the personal account created in the "U-MOKE URBAN" application, which must correspond to the information on their provided driving license. If the information provided by the customer is inaccurate and does not match the data of the holder of the personal account of the "U-MOKE URBAN" application, U-MOKE reserves the right to cancel the reservation and any additional coverage subscribed. In case of several failed payment attempts, U-MOKE reserves the right to block the customer's personal account in the "U-MOKE URBAN" application.
11. In case of an accident, criminal act or vandalism (see point 11.1) committed against the vehicle, the Renter will have the obligation to:
- Immediately report the facts to the police.
- Fill out an amicable accident report according to the official model found in the Vehicle, indicating at least the registration number, the name and address of the opposing party, in addition to the name of the insurance company, and, if applicable, the insurance policy number.
- Describe the accident concisely and accurately, and if applicable, note the names of witnesses.
- Not prejudge or acknowledge any liability for the accident.
- Not abandon the vehicle without taking adequate measures to protect it from further damage and leave it locked without obstructing traffic.
- Immediately inform U-MOKE of the incident by calling the emergency telephone number: +34 633 662 681.
In the event of an accident or criminal act, the Lessor will not be obliged to provide another rental vehicle to the Renter; in this case, it will be considered that the Agreement has been terminated between both parties, Lessor and Renter, and the Renter will have to pay all costs arising from the Agreement to the Lessor. However, the Lessor may offer a new vehicle, according to the conditions in force at that time, in order to replace the vehicle involved in the accident, criminal act or vandalism. U-MOKE will not be responsible for any damage or loss caused to property or objects being transported. The Lessor is exempt from any liability for damages or losses resulting from the use of the vehicle or in the event of an accident or incident during the rental period.
11.1. Examples of criminal acts or vandalism committed against the vehicle
Theft or larceny of the vehicle. Theft or larceny of exterior or interior parts of the vehicle such as wheels, tires or seats. Robbery with violence causing damage to the windows or bodywork of the vehicle. Vandalism against the vehicle. The preceding list is provided as examples only and is not exhaustive.
12. Unauthorized use of the vehicle
The Renter will be obliged to use the Vehicle with due diligence and care, in accordance with its characteristics, respecting the current highway code for motor vehicles, and avoiding, in all cases, any situation that could cause damage to the vehicle or to third parties. Likewise, whenever the provisions stipulated in this point are not respected, it will be considered that an unauthorized use has been made. The Renter has the obligation not to allow the vehicle to be driven by persons other than those authorized in accordance with this Agreement and the Renter is directly responsible for any damage or harm caused to the vehicle or to third parties in this case. The Renter will be fully responsible for damages caused to the interior and exterior parts of the vehicle due to their unauthorized use. In case of unauthorized use of the vehicle, the renter is obliged to pay all costs resulting from these damages, the specified amount will be paid with charges to the renter's credit card, with the renter showing their express agreement for all purposes. The Renter's signature on the Agreement will be considered as acceptance of the general and specific conditions specified contractually. Unauthorized use includes, but is not limited to, the following cases cited as examples:
- Participation in competitions.
- Illegal races.
- Driving without authorization or a driver's license, or without the lessor's authorization.
- Transferring the vehicle to a third party.
- Pushing or towing any other vehicle.
- Driving in places not suitable for public transport, such as beaches, car racing circuits, etc.
- Driving on roads that could damage the vehicle's underbody or crankcase.
- Negligent behavior when warning lights or signals on the vehicle's dashboard light up, which the renter acknowledges knowing by signing this contract.
- Transporting goods or animals in the vehicle.
- Transporting furniture, except for vehicles specifically designed for this purpose.
- Transporting people or goods that directly or indirectly involves a payment to the renter (e.g., using the vehicle as an illegal "taxi").
- Sub-leasing the vehicle.
- Transporting a number of people or luggage greater than what is authorized for the vehicle, according to the number of seat belts.
- Transporting luggage on the roof of the vehicle (installing a roof rack is prohibited).
- Leaving objects visible in the vehicle.
- Soiling the interior of the vehicle.
- Driving the vehicle while fatigued, ill, or under the influence of alcohol, medication, or drugs.
- Reckless driving.
- Driving contrary to traffic regulations.
- Driving the rented vehicle by a person not authorized in the contract as a renter or additional driver.
- Driving the vehicle outside the authorized area, as indicated in point 16 of these conditions.
- Using the vehicle after the end of the rental period.
- Not using a baby and/or child seat if traveling with persons under 12 years of age or shorter than 135 cm.
- IT IS STRICTLY FORBIDDEN TO SMOKE INSIDE THE VEHICLE. All our vehicles are strictly non-smoking. In case of non-compliance with this rule, or if deterioration is noted (bimini, seats, floor mats...) or if additional cleaning is necessary to remove tobacco odors, a surcharge will be added to the invoice to cover the costs of restoring the vehicle to its original non-smoking condition.
13. Traffic Violations
The Renter will be responsible for paying fines generated during the vehicle rental period and must inform the Lessor of any violation and/or sanction imposed on the vehicle or the driver during said period. The Lessor, to the extent permitted by current legislation, will charge up to 25 euros for administrative costs incurred in processing requests that competent authorities or other third parties address to the Lessor in relation to administrative infractions, possible criminal acts or other offenses committed during the rental period for each file. The payment of fines and their management are not included in any of the coverages that can be subscribed, unless otherwise indicated. If the Lessor has paid the amount related to an infraction or other sanction committed by the Renter during their rental period, the latter will be responsible for this amount, which will be charged to the same means of payment provided by the Renter at the time of signing the contract. In case of retention of the vehicle by the authorities due to an act or omission on the part of the Renter, for whatever reason, the latter will be responsible and will indemnify the Lessor for all costs and lost profits that may have been generated as a result. In addition, an amount of 250 euros will be charged to the means of payment provided at the time of signing the rental contract for the immobilization of the vehicle, in order to cover the towing and/or administrative costs allowing the Lessor to recover possession of the vehicle. This amount does not prejudice the right to claim other sums if the towing and/or administrative costs exceed this amount. If the amount is lower, a refund will be made.
14. Joint and Several Liability
All Renters and/or additional drivers will be jointly and severally liable for all the obligations assumed by the Renter in the Agreement and for all the legislation applicable to it.
15. Fuel Policy
At the actual time of booking and depending on the rate selected by the renter, one of the following options will be applied:
- Full / Refundable: The Renter will pay for 100% of the tank at the time of Vehicle Check-Out. At Check-In, the Lessor will check the fuel level of the tank at that moment: the amount of fuel remaining in the tank will be refunded according to the eight-octane marker, minus the administrative refueling fees.
- Full / Full: At Check-Out, the Lessor has delivered the vehicle with a full tank, and for their part, the Renter must return the vehicle with a full tank at Check-In. If the Lessor fails to fulfill their obligation to refuel, the Renter may demand at Check-Out that the vehicle be delivered to them with a full tank. If they do not make this claim at that time, it will be considered that they are compliant. If, on the contrary, it is the Renter who fails to fulfill their obligation to refuel at Check-In, they will be charged a refueling management fee plus the missing liters to reach 100% of the tank.
In case of incorrect refueling of the vehicle, a charge for a full tank of fuel will be billed, as well as a surcharge for the damage caused by the incorrect fuel.
15.1. Electric Vehicles
We guarantee that the vehicle will always be delivered with at least 85% charge. It is necessary to return it with a minimum level of:
- 10 to 15% battery for a one-day rental;
- 85% in the case of a rental of 24 hours or more;
Fees would be applied depending on the charge level. The Renter agrees to strictly follow the charging instructions for the electric or plug-in hybrid vehicle. The use of charging cables or other accessories not authorized by U_MOKE for the vehicle or the corresponding charging point is strictly prohibited. The Lessor cannot be held responsible for the possible inability to charge the vehicle at charging points. At the end of the rental, the charging cables provided must be returned with the vehicle. In case of non-compliance, the Lessor will charge the Renter for the cost of the missing accessory.
16. Authorized Territory
Below, we detail the list of authorized regions for the circulation of our vehicles: Unless expressly authorized, it is forbidden to move the vehicle from the peninsula to any island and/or from an island to the peninsula. It is forbidden to cross borders outside the European continent, including the prohibition of travel to Ceuta and Melilla. In addition, it is forbidden to circulate in the following countries, as well as in any other country not previously mentioned: Albania, Belarus, Bosnia and Herzegovina, Kosovo, North Macedonia, Moldova, Ukraine, Russia, Turkey, United Kingdom. Territorial restrictions may vary depending on the country of rental of the vehicle. The vehicle may not be boarded or transported by any means of transport, unless expressly authorized in writing by the Lessor. We inform you that our vehicles are equipped with geolocators and if we detect that they have exceeded the authorized territory, by fault or negligence, this will be considered a breach of contract, which will result in the immediate termination of the contract due to a contractual breach on the part of the renter, with a penalty corresponding to the amount indicated in the attached appendix under the concept "Passage into unauthorized territory", and the Lessor may also claim compensation for damages if these are greater than this amount.
17. Mileage
In the Balearic Islands and the Canary Islands: unlimited per rental period. In the rest of the authorized territories: 300 km per day during the rental period, and a maximum of 3,000 km in total. If this limit is exceeded or if the Vehicle is used after the end of the Agreement, a surcharge will be applied for excess mileage.
18. Extras
The Lessor offers different types of additional options to complete the customer experience. You can consult the cost of these services in the additional options table attached to this contract.
18.1. Young Driver
Allows young drivers aged between 18 and 25 with a valid driver's license to rent a vehicle from our company and enjoy the same freedom and comfort as older drivers. If the driver is new and has less than one year of experience with the driver's license, it will be the renter's responsibility to provide the required identification in the country where they plan to drive. The cost of this service is detailed in the attached appendix.
18.2. Second Driver
An optional supplement allowing a second person to drive the vehicle. The cost of this service is detailed in the appendix attached to this contract.
18.3. Transport of Baby/Child
It is forbidden to transport minors with a height equal to or less than 135 cm as the vehicle is not equipped with the adequate equipment for the attachment of approved child restraint systems. The Lessor assumes no responsibility for personal and/or material damages, direct or indirect, resulting from the installation, failure to check and/or incorrect use of the restraint system by the Renter. Loss and/or breakage are not covered by any of our warranties.
19. Payment
The customer is obliged to pay all amounts due to U-MOKE by means of a credit card (VISA, MASTERCARD, AMEX or Bitcoin) or debit card, unless otherwise agreed. Payment for reservations via our website can only be made with the credit or debit cards mentioned above. The customer's failure to comply with any payment obligation authorizes U-MOKE to terminate the rental contract by operation of law and to demand the immediate return of the vehicle, as well as the payment of the amount due. For this purpose, U-MOKE may use the services of bad debt management providers, with the customer being responsible for the costs incurred by U-MOKE in the collection process, including, where applicable, the costs of recovering the vehicle.
20. Currency
The rates are set by the Lessor in euros (€) and can be converted into any other currency using the converter: https://www.google.com/finance/converter, without any commitment on its part in case of conversion error. It is possible to make the payment in all our facilities in the currency of your contract, only with the credit cards indicated in the previous point.
21. Taxes
All prices indicated in the rates include the applicable Value Added Tax (VAT). The Rental Company is not responsible for any additional taxes imposed by any state, region, or local authority during the term of this Agreement.
22. Jurisdiction and Applicable Law
This Agreement is governed by the national legislation on the matter. The Parties submit to the Transport Arbitration Courts and to the Courts and Tribunals of the country for all incidents and questions arising from this Agreement, except those relating to consumer matters, which will be governed by the jurisdiction established in the regulations thereof.
22.1.
According to the regulation on online dispute resolution in consumer matters (EU Regulation No. 524/2013), reference must always be made to the EU platform for online dispute resolution. This also applies if there is no willingness to participate in such a procedure.
23. Cancellation Policy
All cancellations must be made by the following means, as appropriate: If cancellation is permitted by the fare conditions, it must be made by telephone at +34 633 662 681. In case of force majeure (natural disaster, war, attack, death or sudden serious illness of the Renter, their parents, siblings, or children), duly justified, the cancellation must be requested via the link: contact@u-moke.com, attaching the corresponding supporting documents. For Non-Refundable Rates, no refund will be made, except for the reasons of force majeure mentioned above.
U-MOKE reserves the right to update these General Conditions and to modify the services at its discretion. U-MOKE must inform the client/Renter in advance of the planned modifications, so that the latter can exercise their right of opposition to these modifications for the remaining duration of the current contract. Communications between the Lessor and the Renter must be made by appropriate means of communication, with a written record, and within a reasonable time. In the event that, within a period of 15 days from the timely communication of the modifications by U-MOKE to the renter, no response is received, these modifications will be deemed accepted.

25. Framework Agreement
These conditions have the character of a framework agreement, and they apply to any rental contract agreed between the same renter and the Rental Company.
26. Translation
The Renter has the right to receive a copy in the official language of these general conditions, and this fact will be indicated in their versions written in other languages, informing them in our facilities of which languages we have at that precise moment. In case of disputes, the deciding version will be the one written in Spanish.
27. Privacy Policy
27.1. Processing of Personal Data
In accordance with EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), Organic Law 3/2018 of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights ("LOPDGDD") and other applicable regulations, the Client is informed that the personal data collected in the context of subscribing to our products and services will be processed by AIRSTEMANO S.L. in its capacity as Data Controller (hereinafter, the "Controller").
27.2. Purpose and Legal Bases for Processing
The personal data collected will be processed for the execution of the rental agreement and all services and products related to it, as well as the preliminary steps for the formalization of the contract. The legal bases for the various processing operations are the execution of the contract, the consent given by the Client, compliance with legal obligations and the legitimate interest of U-MOKE. The Client is informed that some of U-MOKE's vehicles are equipped with geolocators. The geolocation data will be processed for the purpose of recovering the vehicle and monitoring driving in the "Authorized Territory" (Clause 15), all of this on the basis of the execution of the contract concluded between the Lessor and the Client.
27.3. Recipients
The data of the data subjects will not be transferred to third parties, except for legal obligation, with their consent, to fulfill our contractual obligations, as well as to satisfy our legitimate interests.
27.4. Third-Party Data
In the case of providing personal data belonging to third parties, the Client declares that they have the consent of the data subjects for this purpose, after having previously informed them of the content of this information regarding data protection and the Controller's Privacy Policy.
27.5. Rights of the Data Subjects
Data subjects may exercise their rights of access, rectification, limitation, deletion, opposition, portability and, where appropriate, not to be subject to automated individual decisions, in writing accompanied by a copy of their identity document and addressed to the address indicated at the beginning of these General Conditions or to the email address: admin@u-moke.com In addition, data subjects may file a complaint with a supervisory authority of the Member State where they reside, where their place of work is located or of the place where the alleged violation was committed. In Spain, the competent supervisory authority is the Spanish Data Protection Agency, located at C / Jorge Juan, 6 28001 - Madrid.
