Article 1. Your contract with us

When you sign the Rental Agreement form you accept the conditions set out below. Read this carefully.

If there is anything you do not understand or do not agree with, please ask.

Article 2. definitions

RENTER:

the person(s) who drive the vehicle(s)and pay for the Hire .

Article 3. Price

The total rental price is established according to the General Tariff valid at the time of rental, according to the selected rate. This price includes, in addition to the lease of the vehicle subject to this contract, the cost of compulsory insurance of third party liability for the circulation of motor vehicles according to regulations approved in the Royal Decree 1507/2008 of September 12 according to current legislation, the extension of this Third Party Liability up to € 50,000,000, insurance of the driver, roadside assistance of the vehicle and passengers, coverage of damages in case of theft, fire and breakage of windscreens, and also includes a maintenance of the vehicle. Article 4. Car conditions – PICK-UP – Custody & Return

The RENTER must provide the rental agency, at the time of signing the Specific Conditions, with an identity document, a valid driver’s license, and proof of residence dated within the last 2 months. The RENTER acknowledges that the vehicle is delivered in good condition, except for any damage noted in the « Vehicle Condition Report. »
The RENTER is responsible for any violations committed during the rental period, and their personal information may be provided to authorities if necessary. The vehicle must be available on the date, time and place of pick-up agreed when the contract is signed, in good condition and with a fully charged battery. Otherwise, additional fees may apply.

Article 5. Vehicle Usage

The RENTER must be over 21 years old and have held a valid driver’s license for at least three years. They agree not to allow any unauthorized person to drive the vehicle and to ensure the car is secured when not in use.
The car  may not be used for:
• Transporting passengers for payment.
• Racing or test-driving events.
• Driving lessons.
• Subletting.
• Transporting hazardous materials.
• Towing another vehicle.
• Committing intentional offenses.
• Driving on highways.
• Leaving the island of Mallorca.

Article 6. Rental duration

The rental period may not exceed 30 days. It is calculated in 24-hour increments, with a 30-minute grace period for return. The RENTER must return the vehicle with its keys and documents to the UMOKE company representative at the location agreed upon in the rental contract. Otherwise, additional charges may apply.

Article 7. Rental price & Payment

The rental rates are valid in Spain and depend on vehicle availability. The RENTER must pay:
• The amount based on the applicable rate.
• Any fines or violations incurred during the rental period.
• Repair costs for improper use of the vehicle.
• The cost of recharging if the vehicle is not returned fully charged.
A security deposit is required at the beginning of the rental and may be used to cover any outstanding charges.

Article 8. Insurance if underwritten by the renter

The vehicle is insured for the RENTER’s civil liability. The deductible in the event of a claim is defined in the Special Conditions. The RENTER must declare any claim within 5 days (or 48 hours in the event of theft). Transported goods are not insured.

If no insurance is taken out, repair costs will be billed to the customer.

Article 9. Accessories: Radio, Hood and Winter cover

The vehicle is equipped with a detachable Alpine CD, USB and Bluetooth radio, which has a cost of 150.00 euros. When the vehicle is parked, stationary or left alone, the radio must be removed and locked in the back compartment of the vehicle to prevent theft. If the radio is stolen, lost or broken due to negligence of the driver, the cost of a replacement radio will be charged to the renter.

At the request of the Renter, the vehicle will be provided with or without hood. If the vehicle is provided with the hood, the manipulation or removal of this is strictly prohibited, without the authorization of The Owner. In the event that the Hirer wishes to have the hood removed during the rental period they must communicate it to qualified staff of The Owner to carry out the removal. If the hood is damaged having been tampered with without authorization the Customer will be charged for the repair with a maximum value of 700.00 euros.

Article 10. Loss of coverage – Renter’s Liability  – Exclusions

Driving under the influence of alcohol or drugs results in the loss of insurance coverage. The RENTER is fully responsible for any damage if they fail to comply with the general rental conditions.

Article 11. GPS

For security reasons, the vehicles are equipped with GPS locators. This GPS data will only be accessed by the Owner in the event of the vehicle exiting the geographical limits, or failure toreturn the vehicle at the agreed drop off time. By signing the rental agreement form the Renter accepts that the location of the vehicle may be traced by GPS.

Article 12. Payment and deposit

Payment methods accepted are cash, debit or credit card (VISA, Maestro, Mastercard, American Express and Paypal. The card must be in the name of the Renter.

Payment by electronic bank transfer is also accepted provided that the funds are received within 48 hours of the reservation.

A deposit of 1,000€ will be frozen on the debit or credit card of the Customer at the delivery of the vehicle. This will be unfrozen upon return of the vehicle after it has been inspected by a member of Umoke staff and provided that the condition of the vehicle is the same as it was delivered.

Article 13. Bookings and Cancellations Online

Reservations paid through UMOKE may be cancelled without charge, up to a 48-hour period prior to collection. Cancellations made 24 hours in advance will only be

reimbursed 50% of the amount. Any cancellations made less than 24 hours prior to the

collection will not be offered any refund.

Important information:

1. It is mandatory to present the reservation confirmation voucher when picking up the vehicle.
2. It is necessary to present the passport, ID or NIE, the driving license and a valid credit or debit card when picking up the vehicle. If the card is different from the one with which the Customer paid for their reservation, they must physically show this card at the request of our staff.
3. If the vehicle is returned more than 59 minutes after the drop off time as per the

reservation The Owner reserves the right to charge the Customer a fee of €40.00 per day

for the delay plus the amount corresponding to the additional rental days (with a

minimum of € 40.00 plus a rental day).

1. If the vehicle receives a fine during the period of validity of this contract you will be

responsible for the amount of the fine, in addition a charge of € 45.00 as administration

cost

1. If the renter returns the vehicle without its corresponding documentation, after

checking the vehicle, an extra charge of € 120.00 will be made.

1. The Owner reserves the right to cancel the delivery of the vehicle in case of doubts based on the financial capacity of the Customer or due to a history of unpaid or serious

incidents with The Owner.

These specific conditions will prevail over the general ones

Article 14. Other provisions

Discounts and special offers cannot be combined. Any damage caused by transporting goods or animals is the responsibility of the RENTER.

Article 15. Juridiction

This contract is governed by Spanish law and subject to Spanish courts.
